Article 1: General
Please read the TERMS AND CONDITIONS carefully before placing your order on www.denaive.com.
The following Terms and Conditions exclusively refer to this website and to the items sold on it by the company SARL DENAIVE DIFFUSION under the brand name DOMINIQUE DENAIVE, hereby called the vendor.
The following Terms and Conditions of SARL DENAIVE DIFFUSION establishes the rights and obligations of all persons involved in the selling and purchasing of products and services produced by the vendor.
These Terms and Conditions may be modified and updated. Please read them and check back before placing order. Any changes made after ordering will not affect that order however, unless the vendor are required to make the change by law.

Article 2: Commercial Policy
The vendor sells products on www.denaive.com and proceeds to its own online commercial activity exclusively for website users, i.e. the website customers.
“Customers” means any individual using www.denaive.com for personal reasons only.
Article 3: Orders / limits of liability
The information given by the customer when ordering incurs his liability:
If the customer’s delivery address is false, the vendor will not be hold by responsible for any impossibility to deliver the products or if the products are delivered to an incorrect address.
By clicking on “Buy” during the ordering process, after checking the shopping cart and if necessary modifying it, the customer agrees to accept the vendor’s terms and conditions without any restrictions. Orders will be accepted while stock lasts.
In case of stock shortage, the vendor will contact you and do the utmost to replace the product by a similar product to the one initially ordered.
Ordering on www.denaive.com requires several steps following by successive screens. The process must be strictly followed in order to complete an order.
After the order confirmation step, the customer will proceed to the payment.
When the order has been shipped, the vendor cannot proceed to any order modification whatsoever.
The vendor reserves the right to refuse any order made by a customer with who the vendor would have engaged a litigation process.
Products may differ from the pictures present on www.denaive.com. Customers should be aware of this and accept it.
The vendor cannot be hold responsible for any difficulties or problems on www.denaive.com caused by a defective or slow Internet connection, or due to an incompatible Internet browser.
Article 4: Pricing and Payment
Product prices can be displayed on the website in Euros EUR (€) or in US Dollars USD ($). The prices include French taxes but exclude shipping and handling fees.
The prices displayed are always the current prices.
The shipping and handling fees will appear automatically on the page while finalizing your shopping cart. Those fees differ from one destination to another.
Information about costs for delivery of a parcel to your country, please refer to the chart in the Article 5 of the Terms and Conditions.
In accordance with the “Article L. 121-19” of the “Code de la Consommation”, the customer will receive, upon delivery, a detailed written confirmation of the total amount that was paid.
If, for any reason whatever, the amount to pay by the customer cannot be charged, the vendor will not process the order.
For each credit card payment, the customer will be automatically redirected to a secure web page, which will ensure maximum security. The vendor uses the latest SSL encryption technology to store and safely transmit personal and credit card information through our systems. All orders are processed through a secure checkout system provided by Stripe and Paypal.

Article 5: Fees for shipping and handling
Delivery will occur when the full amount due has been paid. Products will only be delivered to the customer’s address filled in at registration and in the schedule mentioned during the ordering.
Orders will be processed within 5 days following placement. The maximum delay is 30 days. Delays only apply to products in stock.
The vendor cannot be held responsible if the delivery fails due to credit card authorization problems.
Handling and shipping fees depend on the final destination. Please refer to the chart in the Article 5 of the Terms and Conditions.
Customs fees are not included. Any customs or import duties are to be paid upon arrival to the destination country. These fees shall be paid by the recipient of the parcel. The vendor has no control over these fees and cannot predict them. Customs policies vary widely from country to country. Please contact your local customs office for further information.
If several orders are placed during the same week by the same customer, the vendor can allow to put all the orders into the same parcel. If you wish a separate shipment by order, please contact us. Extra fees might be requested to cover the costs of shipping.
Delivery time is from three to five working days. Deliveries to France and International are made through COLISSIMO or UPS.
If requested by email, the vendor will provide the customer a tracking number so that the parcel can be located at any time.
The vendor cannot be held responsible for the dysfunction of the tracking systems of our partners.
If the delivery is impossible due to any reason whatsoever such as wrong address, wrong name, number on door code, etc., it will require a longer delay as the parcel has to be returned before re-sending.
In the case of a customer not available at the time for the delivery, the driver will leave a calling card with instructions on how to pick it up.
If the delivery of one order has to be made in several parcels, the customer will only pay the shipping and handling fees only once.
Article 6: Confidentiality
The vendor certifies that the personal information required for registration and order processing will be kept confidential and, in any way, never sold to any other part.
For each credit card payment, the customer will automatically be redirected to a secure web page, which will ensure maximum security. The secure payment platform we use are PAYPAL & STRIPE, the latest SSL encryption technology to store and safely transmit personal and credit card information through our systems.
Article 7: Intellectual Property Rights (IPR)
www.denaive.com and all its components are the exclusive property of SARL DENAIVE DIFFUSION.
The user has no right to link to the website, on any other website, personal or not. Nor has the user have any right to copy or to recreate any of its contents.
Article 8: Returns, Exchanges and refunds
Returns, Exchanges and refunds will be processed after agreement between the customer and the vendor.
Returns: Any items returned must be sent exactly its original condition. All items will be inspected on return. The goods are under the customer’s responsibility until reaching the vendor’s warehouse.
The initial bill should be enclosed to any return whatsoever, and added with a “Retour/Echange” form (return/exchange form) precising the reasons of the return or exchange.
Return shipments are to be paid by the customer and cannot be refunded.
Returns may lead to a refund or an exchange according to the following terms and conditions:
Refunds: In accordance with the “article L. 121-20” of the “Code de la consommation”, the customer has a right of seven days to retract his purchase, starting from the receipt of the parcel.
Within this period, the customer can receive a full refund. The money will be refunded on the credit card that was used to proceed with payment initially, and within 30 days.
Exchange: Only defective items can be exchanged with prior agreement by email from the vendor.
In the case of an obvious faulty product, the exchange will be free of charge for the customer. If so, the customer will either receive a replacement product or, if impossible, will receive a total refund.
Beyond the legal period of 7 days, the vendor has the right to refuse any exchange or refund.

Article 9: Litigations and Applicable Law
These Terms and Conditions refer to the French Law. The competent court in cases of litigation is the “Tribunal de Commerce de Paris” (Commerce court of Paris).
In case of litigation, the customer must contact the vendor in prior to find a settlement.
The DOMINIQUE DENAIVE Customer Service will always carefully listen to inquiries and requests and do the utmost to assist and help customers.
